Amends the Code of Criminal Procedure of 1963 and the Illinois Domestic Violence Act of 1986. Provides that the court may include in the order of protection granting the petitioner the exclusive care, custody, or control of any animal owned, possessed, leased, kept, or held by either the petitioner or the respondent or a minor child residing in the residence or household of either the petitioner or the respondent and ordering the respondent to stay away from the animal and forbidding the respondent from taking, transferring, encumbering, concealing, harming, or otherwise disposing of the animal.

Amends the State Finance Act. Provides that transfers from the Adeline Jay Geo-Karis Illinois Beach Marina Fund to the General Revenue Fund shall not exceed $1,000,000 (now, $2,000,000) in any fiscal year. Transfers an amount equal to the amount transferred from the Adeline Jay Geo-Karis Illinois Beach Marina Fund to the General Revenue Fund under certain provisions of the State Finance Act during fiscal years 2004, 2005, 2006, and 2007 from the General Revenue Fund to the Adeline Jay Geo-Karis Illinois Beach Marina Fund. Excludes the Adeline Jay Geo-Karis Illinois Beach Marina Fund from a provision of the State Finance Act that allows the Governor to transfer moneys from certain special funds into the General Revenue Fund. Effective immediately.

Synopsis As Introduced
Amends the Rivers, Lakes, and Streams Act. Requires the Department of Natural Resources to adopt emergency rules under the Illinois Administrative Procedure Act to require the immediate marking of each dam the Department considers dangerous with signs and buoys warning the public of the hazards posed by the dam. Provides that the rules shall require that warning signs be placed on the dam and that warning signs and buoys be placed in the areas above and below the dam and on the banks immediately adjacent to the dam. Provides that the Department shall examine each dam located on navigable waterways to determine the hazards that exist at each dam and that the Department shall require the establishment of specifications for signs and devices that provide warnings and information for persons using the waterways. Provides that, after conducting the required examination and within 90 days after the effective date of the amendatory Act, the Department shall issue an order, with completion dates, specifying additional warning signs and safety devices to be required at the dam. Provides that the Department shall require each dam to have localized safety plans to maximize the safety of persons visiting the dam. Provides that the Department may designate enforceable exclusion zones around dams. Provides that any low-head dam owned by the State shall be maintained so that any scour hole formed at the dam shall not exceed 2 feet below the riverbed in depth. Effective immediately.

Deletes everything after the enacting clause. Amends the Rivers, Lakes, and Streams Act. Requires the Department of Natural Resources to establish specifications, by administrative rule, for signs and devices that provide warnings of the presence of dams for persons using the public waters of the State. Provides that, for dams located in public waters (instead of navigable waterways) and that are not subject to federal regulation regarding safety standards, the Department of Natural Resources shall examine each dam to determine hazards that may exist at each dam. Removes the requirement that the Department issue an order, with completion dates, specifying additional warning signs and safety devices required at each dam within 90 days after the effective date of the amendatory Act and after the completion of the Department's examination to determine hazards that may exist at the dam. Provides that violation of the exclusion zones around a dam is a Class A misdemeanor. Provides that, except for willful and wanton misconduct, neither the Department of Natural Resources nor employees or agents of the Department shall be liable for damages, injuries, or deaths occurring at dams located in public waters by reason of the Department's regulations. Removes language requiring low-head State-owned dams to be maintained so that any scour hole formed at the dam shall not exceed 2 feet below the riverbed in depth. Makes other changes. Effective immediately.

Amends the Criminal Code of 1961. Creates the offense of aggravated domestic assault when a person, in committing domestic assault, knowingly or intentionally uses a deadly weapon or certain other devices against a family or household member. Requires a peace officer to arrest the offender upon the establishment of probable cause. Makes the offense a Class 4 felony.

Provides that a peace officer may arrest a person for aggravated domestic assault (rather than must arrest the offender upon the establishment of probable cause) if the officer has probable cause to believe that there is imminent danger of physical harm to the non-aggressor. Provides that the penalty for aggravated domestic assault is a Class A misdemeanor (rather than a Class 4 felony). Provides that aggravated domestic assault is a Class 4 felony if the defendant has any prior conviction for domestic assault, aggravated domestic assault, domestic damage to property, domestic battery, or aggravated domestic battery. Provides that the offense of aggravated domestic assault does not apply to a parent or guardian while exercising parental discipline over a child under his or her custody. Amends the Unified Code of Corrections. Provides that if the defendant committed aggravated domestic assault and has a prior conviction for domestic assault, aggravated domestic assault, domestic damage to property, domestic battery, or aggravated domestic battery, the prior conviction is an aggravating factor that the court may consider in sentencing.

Creates the Retail Sale of Dogs and Cats Act. Imposes various requirements on pet dealers who sell dogs or cats. Provides that an animal must be examined by a licensed veterinarian before being placed with other animals by a pet dealer. Provides that a pet dealer must give the purchaser of a dog or cat a written statement containing certain information about the animal purchased and maintain a record of that information. Requires certain standards of care for animals. Imposes civil monetary penalties on a pet dealer for violations. Provides remedies for a purchaser if an animal becomes ill or dies as a result of an illness that existed in the animal at the time of purchase. Sets out a notice of an animal purchaser's rights, and requires that notice to be given to each purchaser of an animal from a pet dealer. Provides penalties for pet dealers who sell diseased or ill animals. Effective January 1, 2008.

Amends the Wildlife Code. Provides that the Department of Natural Resources is responsible for the operation of a hound running areas permit program. Provides that a coyote may be held or possessed by a person who holds a hound running area permit. Provides that hound running areas approved by the Department are exempt from certain limitations in the Game Protective Article of the Wildlife Code. Limits hound running areas to a fenced area that has at least 40 acres, that is used by dogs and people to chase foxes or coyotes without the intent to kill or capture the foxes or coyotes, and that has a dog-proof escape area for the chased animals. Requires the applicant for a hound running area permit to hold or apply for a fur-bearing mammal breeder permit. Authorizes the Department to promulgate rules, make inspections, and administer this program. Provides that a person that violates the requirements for a hound running area permit is guilty of a Class B misdemeanor. Amends the Illinois Dangerous Animals Act to provide that a hound running area may be used to keep and maintain coyotes in an escape-proof enclosure. Makes other changes.

Creates the Illinois Conservation Corps Act. Provides year-round conservation employment within the Department of Natural Resources for young adults in Illinois. Subject to appropriation, entitles enrollees in the Corps to a stipend of $500 per month and a maximum of $5,000 per year in education awards. Provides that no project of the Corps may displace individuals employed by or under contract with the Department. Creates the Illinois Conservation Corps Advisory Board to advise the Department concerning the Corps. Establishes the Illinois Conservation Corps Fund, a special fund in the State treasury. Authorizes the Department to use the moneys in the Fund only for the purposes of the Corps and provides that no more than 5% of the moneys in the Fund may be used for costs associated with the administration of the Corps. Authorizes the Fund to accept State and federal appropriations, gifts, grants, and private donations. Prohibits the Governor from making any transfers from the Fund. Amends the State Finance Act to create the Fund. Amends the State Finance Act to prohibit the Governor from making any transfers from the Illinois Conservation Corps Fund. Amends the Illinois Youth and Young Adult Employment Act of 1986 to rename the Illinois Conservation Corps as the Youth and Young Adult Conservation Employment Program. Makes corresponding changes. Amends the Personnel Code, the Department of Natural Resources (Conservation) Law of the Civil Administrative Code of Illinois, and the Illinois Pension Code to make corresponding changes. Effective immediately.

Amends the Illinois Lottery Law. Requires the Department of Revenue to offer a special instant scratch-off game, named the wild about animals scratch-off game, for the benefit of endangered species, humane education programs, dogs, and cats to commence on January 1, 2008. Provides that the net revenue from the game shall be deposited into the Endangered Species Rehabilitation Fund for appropriation by the General Assembly as follows: (i) one-third of net revenue to the Department of Natural Resources for making grants for the maintenance of wildlife rehabilitation facilities that take care of threatened or endangered species; (ii) one-third of net revenue to the State Board of Education for character and humane education programs; and (iii) one-third of net revenue into the Pet Population Control Fund. Sets forth certain provisions for the operation of the scratch-off game. Amends the State Finance Act to create the Endangered Species Rehabilitation Fund. Effective immediately.

Provides that in counties adjacent to a county with more than 3,000,000 inhabitants, by resolution of the county board or boards or by petition signed by 5% of the voters who voted in the county in the last gubernatorial election, a proposal to elect or appoint a 5 or 7 member board of trustees chosen at large or from single member subdistricts of the conservation district shall be submitted to the voters at the next general election. Provides transition procedures if the proposition is approved by a majority of the voters in the district. Provides that the Compact creates the Great Lakes-St. Lawrence River Basin Water Resources Council, which shall consist of the governors of the parties to the Compact ex officio. Sets forth the jurisdiction, organization, powers, and purposes of the Council. Sets forth the purposes of the Compact, including the protection and conservation of waters and water dependent resources and the promotion of interstate and state-provincial comity. Provides that all appointments by the Governor under the Compact are subject to the advice and consent of the Senate. Effective immediately.

Exempts, from provisions prohibiting the sale, manufacture, purchase, possession, or carrying of specified weapons, an active member of a bona fide, nationally recognized military re-enacting group possessing a vintage rifle or modern reproduction thereof with a barrel or barrels less than 16 inches in length if: the modification is required and necessary to accurately portray the weapon for historical re-enactment purposes; the re-enactor possesses a valid and current re-enacting group membership credential; the overall length of the weapon as modified is not less than 26 inches; and the vintage rifle or modern reproduction thereof is used only during the historical re-enactment.

Provides that a person commits disorderly conduct when he or she knowingly possesses while on, brings onto, or causes to be brought onto school property, property in which a school sponsored activity or event is being conducted, or property in which any activity or event that bears a reasonable relationship to school is being conducted, any facsimile firearm. Defines "facsimile firearm" as any replica, toy, starter pistol, or other object that bears a reasonable resemblance or that reasonably can be perceived to be an actual firearm. Provides that a second or subsequent violation by a person under 13 years of age at the time of the commission of the offense is a Class A misdemeanor.

Provides that the Task Force is created within the Office of the Attorney General and that the Attorney General is responsible for administering the activities of the Task Force. Requires the Task Force to explore the technical and procedural changes that are needed in order to implement a unique identification number system to replace the use of social security numbers by State and local government agencies. Requires the Task Force to report to the Governor, the Attorney General, the Secretary of State, and the General Assembly by December 31 of each year (now March 1, 2006). Synopsis As IntroducedAmends the Criminal Code of 1961. Provides that it is unlawful for any person to store or leave, within premises under his or her control, a firearm if the person knows or has reason to believe that a minor under the age of 18 (rather than 14) years who does not have a Firearm Owners Identification Card or who is not serving in the military is likely to gain access to the firearm without the lawful permission of the minor's parent, guardian, or person having charge of the minor unless the firearm is secured. Eliminates the provision that the person who stores or leaves the firearm is criminally liable only if the minor causes death or great bodily harm with the firearm. Provides that if the minor causes death or great bodily harm with the unlawfully stored firearm, the penalty is a Class A misdemeanor (rather than a Class C misdemeanor). Eliminates the provision that the firearm may be placed in some location that a reasonable person would believe would be secure from a minor.

Synopsis As IntroducedAmends the Firearm Owners Identification Card Act. Requires a person who is not a federally licensed importer, manufacturer, or dealer and who desires to sell or transfer a firearm of a size that may be concealed upon the person to another person, who is not a federally licensed importer, manufacturer, or dealer, to do so only at the place of business of a federally licensed firearm dealer. Provides that the federally licensed firearm dealer shall conduct a background check on the prospective recipient of the firearm and follow all other applicable federal, State, and local laws as if he were the seller of the firearm. Provides that the purchaser or transferee may be required by the federally licensed firearm dealer to pay a fee not to exceed $10 per firearm, plus any applicable fees. Makes exceptions for (i) the transfer of a firearm between spouses, a parent and child, or a grandparent and grandchild, (ii) transfers by persons acting pursuant to operation of law or a court order, or (iii) transfers on the grounds of a gun show.

Provides, however, that the prohibition does not apply to a person who makes occasional sales, exchanges, or purchases of concealable firearms for the enhancement of a personal collection or as a hobby, or who sells all or part of his or her personal collection of firearms. Sets forth provisions concerning application, fees, duration of licensure, license retention requirements, submissions to the Department, penalties, revocation, and suspension. Provides that an animal may be adopted even if it has not been rendered incapable of reproduction and microchipped if (i) a licensed veterinarian certifies that the dog or cat is too sick or injured to be sterilized or that it would be detrimental to the health of the dog or cat to be spayed or neutered and (ii) the adoptee has executed a written agreement promising to have such service performed, including microchipping, within 14 days after a licensed veterinarian authorizes a statement that the dog or cat is healthy enough to be sterilized. Provides that the designation of "potentially dangerous dog" shall expire 12 months after the animal is deemed potentially dangerous.

Provides that 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a semi-automatic assault weapon, an assault weapon attachment, any .50 caliber rifle, or .50 caliber cartridge. Provides that beginning 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a large capacity ammunition feeding device. Provides that these provisions do not apply to a person who possessed a prohibited weapon, device, or attachment before the effective date of this amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of this amendatory Act. Provides that on or after the effective date of this amendatory Act, such person may transfer such device only to an heir, an individual residing in another state maintaining that device in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately.

Synopsis As IntroducedAmends the Illinois Vehicle Code and the State Finance Act. Provides that the Secretary of State, in compliance with the federal REAL ID Act, may issue a driver's certificate that clearly states on its face that it may not be accepted by any federal agency for federal identification or any other official purpose. Provides that the driver's certificate must be distinguishable from a driver's license or permit. Provides that one of these driver's certificates may be issued to an applicant who is an immigrant residing in this State, is ineligible to obtain a social security number, and is ineligible to receive a driver's license. Establishes requirements for the application. Provides that an applicant for one of these certificates must pay an additional fee of not less than $50, to be set by the Secretary of State by rule, to be deposited into the Secretary of State Immigrant Driver's Certificate Fund. Creates the Secretary of State Immigrant Driver's Certificate Fund as a special fund in the State treasury. Provides that moneys deposited into the fund shall, subject to appropriation, be used by the Secretary of State to pay for the additional costs associated with immigrant applicants for driver's certificates. Provides that a person denied a driver's certificate may seek administrative review. Provides that a driver's certificate may not be used to obtain a Firearm Owner's Identification Card or a driver's license from another state. Provides that the Secretary of State shall, in conjunction with the Illinois State Police, establish administrative procedures for determining and identifying ineligible Firearm Owner's Identification Card applicants to ensure compliance with the Firearm Owners Identification Card Act. Provides for severability of the bill's provisions. Effective immediately.

Local units of government would experience the biggest fiscal impact. They would be responsible for funding research on new techniques to control deer population. Because the local unit of government would be evaluating the results of the research and not qualified scientists, the local unit of government takes a risk of implementing a deer management program that is costly, ineffective, and delays resolving their deer problems.
House Amendment No. 2Provides that the scientific study conducted by a municipality or other unit of local government must be approved by the Department of Natural Resources. Provides that a Section concerning local control of deer population is repealed on January 1, 2014.

Provides that these provisions do not apply to a person who possessed a prohibited weapon, device, or attachment before the effective date of this amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of this amendatory Act. Provides that on or after the effective date of this amendatory Act, such person may transfer such device only to an heir, an individual residing in another state maintaining that device in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately.

Provides that the Secretary of State is authorized to suspend or revoke the driver's license or permit of any person who has used a motor vehicle in the commission of any of the following offenses: unlawful use of weapons by felons or persons in the custody of the Department of Corrections; aggravated discharge of a firearm; aggravated discharge of a machine gun or of a weapon equipped with a silencer; reckless discharge of a firearm; aggravated unlawful use of a weapon; or being an armed habitual criminal (as well as providing for the suspension or revocation of the driving privileges of anyone who has used a motor vehicle in the commission of the offense of unlawful use of a weapon). Provides that the suspension shall be for one year if the violation is a misdemeanor or a Class 3 or Class 4 felony and shall be for 3 years if the violation is a Class X, Class 1, or Class 2 felony (rather than being for one year in all cases). Deletes language providing for the suspension or revocation of the driving privileges of a person who was in a motor vehicle at the time he or she committed the offense of aggravated discharge of a firearm.

Also requires instruction in the law relating to firearm use. Requires an applicant to be at least 21 years of age. Creates the Citizen Safety and Self-Defense Trust Fund in each county administered by the sheriff. Provides that the moneys in the Fund shall be used to administer the Act. Provides that the Family and Personal Protection Act supersedes an ordinance of a unit of local government inconsistent with that Act. Exempts from an unlawful use of weapons and aggravated unlawful use of weapons violation persons who carry or possess firearms in accordance with the Family and Personal Protection Act. Sets forth additional requirements for grants for green infrastructure projects. Provides that, in considering applications for certain grants, the Department shall give scoring points to the applicants that demonstrate the greatest potential for improving water supply and quality or for reducing the capital, operating, or maintenance costs of meeting water-related infrastructure requirements. Creates the Open Space Bond Repayment Fund and the Natural Areas Bond Repayment Fund. Makes other changes. Effective immediately.

Provides that no person may sell or otherwise transfer, expose for sale or transfer, or have in his or her possession with the intent to sell or transfer any concealable firearm without being licensed under the Act. Provides, however, that the prohibition does not apply to a person who makes occasional sales, exchanges, or purchases of concealable firearms for the enhancement of a personal collection or as a hobby, or who sells all or part of his or her personal collection of firearms. Sets forth provisions concerning application, fees, duration of licensure, license retention requirements, submissions to the Department, penalties, revocation, and suspension. Grants rulemaking authority to the Department and provides that for the purpose of determining compliance with the Act, the Act may be enforced by any municipality in which a licensee is located or, if a licensee is not located in a municipality, by the county in which a licensee is located.

Synopsis As IntroducedAmends the State Finance Act and the Firearm Owners Identification Card Act. Creates the Community Policing Grant Fund in the State treasury. Provides that moneys in the Fund shall, subject to appropriation, be distributed upon the approval of the Director of State Police as grants to local law enforcement agencies for community policing programs. Provides that moneys in the Fund shall be distributed proportionately to local law enforcement agencies in each county based upon the fees collected from the issuance of Firearm Owner's Identification Cards to residents of that county. Increases the fee for the issuance of a Firearm Owner's Identification Card from $5 to $10. Provides that $5 of the fee shall be deposited into the Community Policing Grant Fund.
Bill Status of SB1471 ISRA Oppose
Synopsis As IntroducedAmends the Criminal Code of 1961 relating to the unlawful use of weapons. Prohibits the sale, manufacture, purchase, possession, or carrying of 50 caliber rifles. Provides that a violation is a Class 2 felony, unless the weapon is possessed in the passenger compartment of the a motor vehicle or upon the person, while loaded, in which case a violation is a Class X felony. Exempts: (1) peace officers while in performance of their official duties; (2) wardens, superintendents, and keepers of prisons, penitentiaries, jails, and other institutions for the detention of persons accused or convicted of an offense; (3) members of the Armed Services or Reserve Forces of the United States or the Illinois National Guard, while in the performance of their official duty; and (4) persons licensed under federal law to manufacture those weapons. Provides that the provision prohibiting the sale, manufacture, purchase, possession, or carrying of 50 caliber rifles does not apply to a person that possesses a 50 caliber rifle before the effective date of the amendatory Act. Provides that such person shall only be allowed to transfer a 50 caliber rifle to a dealer licensed as a federal firearms dealer on or after the effective date of the amendatory Act.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Criminal Code of 1961. Provides that 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed any .50 caliber rifle or .50 caliber cartridge. Provides that these provisions do not apply to a person who possessed a prohibited weapon before the effective date of the amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of the amendatory Act. Provides that on or after the effective date of the amendatory Act, such person may transfer such weapon only to an heir, an individual residing in another state maintaining that weapon in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately.
Senate Floor Amendment No. 2Provides that the definition of antique firearm is as defined in the Code of Federal Regulations (rather than as defined in the federal Gun Control Act of 1968). Deletes provision that requires a person who possessed the .50 caliber rifle or .50 caliber cartridge before the effective date of the amendatory Act to provide proof of ownership to the Department of State Police within 90 days after the effective date of the amendatory Act in order to be exempt from violating the amendatory Act.

Synopsis As IntroducedAmends the Department of Agriculture Law of the Civil Administrative Code of Illinois. Creates the Emerald Ash Borer Revolving Loan Program and the Emerald Ash Borer Revolving Loan Fund. Provides that the program shall provide low-interest or zero-interest loans to units of local government for the reforestation of trees on public lands that are within quarantine areas infested by the emerald ash borer.
